Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and TireMaster Ontario ("Company," "we," "our," or "us"), a tire service business located at 1425 Main Street, Richmond Hill, Ontario L4B 3N2. By accessing our website, visiting our facility, or using any of our tire and automotive services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

Description of Services

TireMaster Ontario provides professional automotive tire services including but not limited to:

  • Tire sales and installation
  • Seasonal tire changeovers
  • Wheel alignment and balancing
  • Tire repair and maintenance
  • Tire rotation services
  • Emergency roadside tire assistance
  • Related automotive maintenance services

All services are performed by certified technicians using professional-grade equipment and industry-standard procedures. We reserve the right to refuse service at our discretion, particularly if we determine that the requested service would be unsafe or impractical.

Service Appointments and Scheduling

Appointments may be scheduled through our website, by telephone, or in person. While we make every effort to honor scheduled appointment times, actual service times may vary due to unforeseen circumstances. We recommend confirming your appointment 24 hours in advance. Customers who arrive more than 15 minutes late for their scheduled appointment may need to reschedule.

For emergency services, we provide assistance on a first-come, first-served basis. Emergency service availability may be limited during peak hours or adverse weather conditions.

Pricing and Payment Terms

All prices are quoted in Canadian dollars and are subject to applicable taxes. Pricing for services is based on current market rates and may change without notice. Written estimates are valid for 30 days from the date of issue. Final charges may vary from estimates if additional work is required or if customer requests modifications to the original scope of work.

Payment is due upon completion of services unless prior credit arrangements have been made. We accept cash, debit cards, and major credit cards. For tire purchases, a deposit may be required for special orders or custom tire specifications.

Warranties and Guarantees

Workmanship Warranty

We provide a 90-day warranty on our workmanship for all installation and repair services. This warranty covers defects in our work and does not cover normal wear and tear, damage from road hazards, or issues arising from customer misuse or neglect.

Product Warranties

Tires and automotive products carry manufacturer warranties as specified by each manufacturer. We will assist customers with warranty claims but are not responsible for manufacturer warranty terms or coverage decisions.

Warranty Limitations

Our warranty obligations are limited to re-performing defective work at no charge or refunding the service fee at our discretion. We are not liable for consequential damages, lost profits, or indirect damages arising from our services.

Customer Responsibilities

Customers are responsible for:

  1. Providing accurate information about their vehicle and service needs
  2. Removing personal items from their vehicle before service
  3. Informing us of any known vehicle defects or concerns
  4. Following recommended maintenance schedules and tire care practices
  5. Promptly reporting any concerns about completed work
  6. Paying for services as agreed upon completion

Liability Limitations

TireMaster Ontario's liability for any claim arising from our services is limited to the amount paid for the specific service in question. We are not liable for indirect, consequential, or punitive damages. Our liability does not extend to:

  • Damage to aftermarket accessories or modifications
  • Loss of vehicle use or transportation costs
  • Pre-existing vehicle conditions or hidden defects
  • Damage caused by customer negligence or misuse
  • Normal wear and tear of tires or automotive components

Important Safety Notice

Vehicle safety is paramount. Customers should immediately report any unusual vibrations, handling issues, or safety concerns following our services. Do not continue driving if you experience any safety-related issues with your vehicle.

Vehicle Condition and Inspection

Before providing services, we conduct a visual inspection of relevant vehicle components. We will inform customers of any obvious safety concerns or recommended additional services. However, our inspection is limited in scope and does not constitute a comprehensive vehicle safety assessment. Customers are responsible for the overall maintenance and safety of their vehicles.

Tire Storage Services

When we provide tire storage services, we store tires in a clean, dry environment. Storage fees are charged annually and must be paid in advance. We are not responsible for tire damage that occurs due to age, manufacturing defects, or pre-existing conditions. Customers must claim stored tires within two years or they may be disposed of at our discretion.

Cancellation and Refund Policy

Service appointments may be cancelled up to 24 hours in advance without penalty. Cancellations with less than 24 hours notice may be subject to a cancellation fee. Refunds for completed services are provided only in cases where our work fails to meet the agreed specifications or warranty terms.

Special orders for tires or automotive products may not be returnable unless defective. Custom or special-order items require payment in advance and may not be refundable.

Intellectual Property

The TireMaster Ontario name, logo, website content, and promotional materials are our intellectual property and may not be used without written permission. Customers may not reproduce, distribute, or create derivative works from our copyrighted materials.

Privacy and Data Protection

Customer information is collected and used in accordance with our Privacy Policy. We maintain records of services performed for warranty and safety recall purposes. Customer information is not shared with third parties except as required by law or as necessary to provide requested services.

Dispute Resolution

We encourage customers to contact us directly to resolve any service concerns. If a dispute cannot be resolved through direct communication, disputes will be resolved through binding arbitration under the laws of Ontario, Canada. Any legal proceedings must be filed in the courts of Ontario.

Force Majeure

We are not liable for delays or failures in service delivery caused by circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, power outages, supplier delays, or government restrictions.

Severability and Modification

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website and will become effective immediately upon posting.

Governing Law

These Terms are governed by the laws of Ontario, Canada, and are subject to the exclusive jurisdiction of Ontario courts. Any disputes arising from these Terms or our services will be resolved under Ontario law.
